The amended CairnsPlan 2016 (V3) has been formally adopted by Cairns Regional Council, with a commencement date of 26 October 2021.
The Amended CairnsPlan incorporates the outcomes of the Freshwater and Stratford Town Planning Survey (2019) and effects updates to various aspects of the CairnsPlan.
Notable amendments include the following:
- Increased levels of assessment for development (including Dwelling House, Dual Occupancy and Reconfiguring a Lot) in certain zones, where also subject to the Neighbourhood Character Overlay and/or Flood Hazard Overlay area
- New and/or changed assessment benchmarks, particularly in respect to the Neighbourhood Character Overlay Code.
The Planning Act 2016 (s. 29) provides the opportunity to make an application to have a superseded planning scheme apply to a proposed development application or proposed development. A person may apply under this provision up to and within 1 year after the planning scheme becomes a superseded planning scheme. Note that if approved by the local government, the superseded planning scheme application must be made within 6 months after the request is agreed to.
